  • 3) Go to department of state web-site.Navigate around it and you will find links to their procedures and interpretations

    4) monitor the forums and see postings

    5) immigration portal used to have links or summaries to AILA liaision minutes with service centers

    6) people used to send me their rfe's, denials and what they lawyers did to get them into the mess.Basically learning how people got into a mess and what uscis did to catch them or to deny their cases

    7) go to dol.gov and look for foreign labor certification; there are FAQ's on perm labors and h-1b

    8) go to uscis.gov and read the INA and CFR's

    --------------------------------------------------------------

If a person is used to reading laws and understanding the hierarchy and then intertwining uscis procedure along with the various service center procedure then you will start to get a clearer understanding.

All of the information is public.Don't rely on what your friend told you as they usually only know what someone else told them.

I had a non compete agreement when I left my employer and couldn't work for one year.During that year; I had nothing to do other then watch tv and watch the portal. No matter how small a question was asked/posted I researched it through all the sources I mentioned above.

Finally; don't do what you think is right or "gut feeling"...

Research it; research it and research it some more.Sometimes what you read at first glance; you make a conclusion to your own benefit without understanding all the other laws/policies/procedures that override it.

  • Not exactly.Whatever one saves by renting can be invested somewhere else.So the apples to apples comparison would be the return homeowner gets on the amount of his monthly mortgage payment that goes towards the principle (home equity) to the return the renter gets on the difference he invested.Return on home equity is currently negative all over US (houses declining in price) where as you still can get some positive returns on 100% safe investment like CDs or US treasury bills.

In any case majority of your payment for the first five year goes towards paying interest. So unless you expect hosue prices to rise in next 3-4 years - a remote possibility, the best we can hope for is they stabilize - there is no monitory benefit to be gained by buying now against renting for some more time and saving more money for your future down payment.

China’s Political Reformers Strike Back (http://blogs.cfr.org/asia/2011/04/29/china%E2%80%99s-political-reformers-strike-back/) By Elizabeth C.Economy | Council on Foreign Relations

Over the past year, the world has watched with growing dismay as China’s leaders have orchestrated a relentless attack on political and cultural openness in their country.Ai Weiwei.Liu Xiaobo.Teng Biao.Gao Zhisheng.Zuo Xiao Zu Zhou.China has rounded up its artists, writers, lawyers and musicians, releasing some, and then arresting more. The result? The country wounds itself deeply by depriving itself of some of its greatest thinkers, most creative forces, and most determined seekers of justice.

Premier Wen Jiabao, who has begun to sound like a broken record, clearly recognizes this.He once again gently stepped into the fray, stating at a meeting in mid-April, «We must create conditions for people to speak the truth.» Yet this time he has some back-upand from a rather surprising place: the Chinese Communist Party’s official newspaper, People’s Daily.

A few days ago, People’s Daily ran an editorial with a number of striking statements, including:

«Only in the midst of competition will the value of ideas be shown, and only through practice can they be tested »
« it is inevitable that various values and ideas, traditional and modern, foreign and homegrown, will collide and clash.»
«Because we serve the people, if we have faults, we do not fear the people criticizing them and pointing them out »
«I disapprove of what you say, but I will defend to the death your right to say it.» (quoting Voltaire)
«Seven mouths and eight tongues are not frightening, but most frightening is when not a crow or sparrow can be heard.» (quoting Deng Xiaoping)

What is behind this fresh salvo from the reform flank?Chinese media professionalsparticularly ones who have retiredhave often been at the forefront of calling for greater political openness. We’ll have to wait to see whether any other media support the People’s Daily or whether the bold editorial staff is simply sacked.

The Chinese frequently, and correctly, remind us that the path of political reform will be decided by the Chinese themselves. The People’s Daily editorial, however, reminds us that the real question is: which Chinese?

Make no mistake about it, IEEE-USA is not for any meaningful reform. They say that they support green card reform but actually they don’t.Otherwise they would have included some green card provisions in this bill, at least 485 filing provision. They make it look like they support green card reform because they do not want themselves to be looked upon as anti-immigrants.But that is who they are.

Just as an example: Ron Hira says that H1s drive down wages when they come and work here.If we go back, Ron Hira says H1s promote outsourcing. If we stay here, Ron Hira says we take jobs of people here.So no matter what we do, the bottom line is, IEEE-USA has a problem with people on H1.They have a problem with our existence, not just here, but anywhere. Why?Because they don't like competition from us.And here is another fact, guys lobbying for this bill are actually racist and they just warp their objective around the economic argument.
Again, IEEE went out of its way to get extra H1Bs for US-educated students. That alone wipes out your arguments because these H1Bs are for foreigners and these people sure will increase competition for people born here.IEEE is not only for meaningful reform, they have the power to do what they want.

  • I'm eligible for EB2 but my employer forcibly filed me in Eb3 category. Now i'm thinking of porting from Eb3 to Eb2 after my 140 gets approved ( By filing a new PERM labor and new 140 of course )

What's wrong you see in my intentions ?Whats wrong you see in the law ?

Friend, How many times, you need to know that even job requirements do get rigged by lawyers and employers to accommodate ppl in eb2/eb3 ...and its not jumping the line ...the person has to restart the labor and 140 in order to change the category ...u cant compare it with labor substitution (if u r comparing !!)

There is no change in his strategy; but what is interesting is: he is now claiming that many of the new (freshmen) Democrats are in fact "Lou Dobb Democrats." :) Is he suggesting that they support his stand?

He is also claiming now that he never opposed legal immigration beyond the 1 million that enters every year.He must have forgotten about his daily telecast on H1Bs (in 2003-2004), whose number is well within the limits of 1 million. What was he screaming about then?

Lou Dobbs is losing it, I think, which can only be a good sign. But if CNN were to fire him, that will be the best thing to happen.

Dobbsians will fail in establishing anti-immigrant sentiments, because at anytime, general psyche of Americans will always be "US is a nation of immigrants".US is different in this respect compared to european nations.

Its time we start referring to him as Communist Lou Dobbs because all he spits out is the communist agenda.People cant make more money, corporations cant make money and everything that doesn't fit into his philosophy is war on the middle cla*s.

and this is the middle cla*s that is spending money like crazy...buying 5000$ television sets and huge SUVs on leases. In the end of course u will not have money if u spend like this.Communist Lou Dobb's philosophy is that there is no personal accountability.Everything that is wrong with people's lives is because of immigrants and corporations.People go berserk with their spending and that comes back to bite them in the bum.then if they are laid off, which happens in every economy across the world, they cannot support their spending habits and all this blame is allotted to corporations and immigrants.

Of course he will have a large viewership...its people who don't want to be accountable that flock to his show and feel happy when they have someone else to blame for their reckless lives.

Congressman, It's (Still) on Us: The Ethics Law's Many Looph*les (http://www.washingtonpost.com/wp-dyn/content/article/2007/08/13/AR2007081300980.html?hpid=topnews) By Jeffrey H.Birnbaum | Washington Post, August 14, 2007

Activists on the reform side of the lobbying debate have been celebrating that Congress finally got around to pa*sing an ethics bill. The question is: Should voters celebrate as well?

Paul A.Miller, a former president of the American League of Lobbyists, thinks the hoorahs should be muted, and he has a point. The legislation bars lobbyists from providing meals and gifts to lawmakers, a provision long sought by the advocates of change as a way to keep well-heeled interests from buying their way into the hearts of decision-makers.

But Miller and others point out that the ban is full of looph*les. The largest of the gaps, Miller said, could end up worsening the public's perception that lawmakers are for sale.

If lobbyists are prevented from buying meals for lawmakers for lobbying purposes, he noted, lobbyists will almost certainly make up for the loss by boosting the number of meals they buy lawmakers as part of campaign fundraising events.

And believe it or not, they will be perfectly able to do so.Lobbying laws are separate from campaign finance laws, and the new ban on meals and gifts applies only to lobbying laws. That means the legislation does not rein in fundraising events, so lobbyists and their clients will still be able to buy food and entertainment for lawmakers at those events.

Hence the following perversity: Lobbyists will not be able to pick up the check for members of Congress unless they also hand the lawmakers a check to help their reelections.

"Lobbyists will move lunches and dinners to the campaign side of things," Miller predicts."They will increasingly get members of Congress for an hour or so to give them a campaign check; that's a better deal for the lobbyists and will also make it more likely for corruption to happen."

Jan W.Baran, the campaign finance expert at the law firm Wiley Rein, finds it hard to imagine that lawmakers can schedule more fundraisers than they already do.But he does think there will continue to be plenty of lobbyist-financed partying thanks to the nearly two dozen exceptions to the meal-and-gift ban.

Baran said that members of Congress will be able to accept invitations from lobbyists to events that are widely attended, including receptions and charity golf tournaments.Lobbyists will also still be allowed to underwrite visits by lawmakers if they have some official or ceremonial role.Members of Congress generally cannot accept tickets to sporting events from lobbyists. But they can be comped to a baseball game if they throw out the first pitch, to a football game if they toss the opening coin or to a NASCAR race if they wave the checkered flag. That's nice work if you can get it, and you can bet there'll be a lot more of it available soon.

Interest groups are also expressing concern about another feature of the legislation. The provision would require more disclosure by organizations about who is paying for and actively participating in the lobbying activities of coalitions and trade groups. At the moment, most of that information is proprietary and protected by Supreme Court decisions that shield the members of many kinds of groups.Organizations are worried that they might, for the first time, have to disclose who their top members are.

But they probably need not worry.Ways are always found to get around laws like this one."The balloon will be pressed, and the air will come out another way," said Kenneth A.Gross, a lawyer at Skadden, Arps, Slate, Meagher & Flom.
